Quality Housing and Work Responsibility Act of 1998; PIH Policy for Dealing With FY 1997 and Prior FY Unobligated Modernization Funds
December 22, 1999 Federal Register
The notice provides information on how HUD will deal with PHAs with FY 1997 and prior unobligated modernization funds in violation of the Quality Housing and Work Responsibility Act. The notice advises that HUD will apply sanctions to HAs with such funds, as follows: (1) HUD will not release FY 2000 modernization funds to HAs with specified unobligated funds until such funds have been obligated and HUD has reviewed all relevant documentation, and; (2) failure to obligate such funds by March 30, 2000 will result in the loss of such funds through ACC default and recapture.

Public Housing Assessment System (PHAS): Transition Assistance on Compliance With Management Indicator #5; PHA Annual Inspection of Units

According to HUD, today's notice provides information to housing authorities with fiscal years ending September 30, 1999, and December 31, 1999 on how to meet the requirements of Management Indicator #5 of PHAS (PHA annual inspection of units and systems). Indicator #5 requires that HAs certify that their units have been inspected using the new Uniform Physical Condition Standards (UPCS). However, since the UPCS software and related guidance have only recently become available and adequate training has not yet been provided, HUD recognized that the HAs will not be able to comply with the UPCS requirement.

Therefore, the notice advises these PHAs that they may meet the requirements of Management Indicator #5 "by certifying that their occupied units were inspected in accordance with HUD's Section 8 Certificate Program Housing Quality Standards."

Public Housing Agency Plans; Option To Extend First Submission Due Date for Certain Public Housing Agencies
November 24, 1999 Federal Register
The document provides notice to those public housing agencies that must submit their first Annual Plans in December 1999 or January 2000, that they have the option to submit their first plans between December 1, 1999 and January 31, 2000, or January 15, 2000 and February 29, 2000, respectively. The Department says that it will soon publish additional information and direction to PHAs on their plan submissions.

Issued November 5, 1999

The notice "distributes for immediate use the October 1999 revision of Form HUD-52520, the Consolidated Annual Contributions Contract (CACC) for the Section 8 Moderate Rehabilitation program." HUD says the notice supersedes Notice 94-29, issued May 26, 1994 as it applied to the Moderate Rehabilitation program.

Public Housing Assessment System (PHAS); Notice of delayed implementation
October 21, 1999 Federal Register
The notice indicates that full implementation of PHAS will be delayed. PHAs with fiscal years ending on September 30, 1999, and December 31, 1999 will receive PHAS "advisory" scores and that physical inspections will continue to be performed by HUD, as part of the PHAS advisory score process. The rule says that these HAs, will receive an assessment score on the basis of HUD's assessment of the PHA's management operations (i.e., the Management Indicator).

The notice also indicates that PHAs with fiscal years ending after December 31, 1999 will be issued PHAS scores.

Notice PIH 99-45 (HA): Extension of Notice PIH 98-55 (HA) which extended Notice PIH 97-57 (HA), Section 8 Certificate and Moderate Rehabilitation Programs - Rent Adjustments

The notice extends the notices 97-57 which established procedures for HAs to use when applying comparability (rent reasonableness) in adjusting base rents when the current gross rents exceed the Fair Market Rent.

Notice of obsolete Public Housing documents pursuant to section 503(d) of the Public Housing Reform Act
October 1, 1999 Federal Register
The notice publishes a list of the documents issued or promulgated under the United States Housing Act of 1937 that are or will be obsolete because of the enactment of the Public Housing Reform Act, also known as the Quality Housing and Work Responsibility Act (QHWRA). Section 503(d) of QHWRA requires HUD to publish the list. HUD not only lists the regulations that are completely eliminated and removed, but also those that have been significantly changed but not removed.

Notice PIH 99-43 (HA): Amendment to the Resident Opportunities and Self-Sufficiency (ROSS) Program Notice of Funding Availability (NOFA)

The notice transmits a copy of the amendments to the ROSS NOFA. The amendments were also published in the September 22 edition of the Federal Register. Privacy Act of 1974; Notice of Planned Large-Scale Implementation of Computer Matching Program: Matching Tenant Data in Assisted Housing Programs

The notice announces that during the fourth quarter of calendar year 1999, HUD plans to implement a computer matching program in Assisted Housing programs for all tenants included in HUD's tenant databases. The program primarily involves "identifying potential income discrepancies" and "initiating administrative or legal actions to resolve income discrepancies and any excess rental assistance tenants received." The Real Estate Assessment Center (REAC) has responsibility for the computer matching program and the related income verification program.

Negotiated Rulemaking Committee on Operating Fund Allocation; Notice of Advisory Committee Renewal

The notice announces the renewal of the Negotiated Rulemaking Committee on Operating Fund Allocation. Since the original committee charter will expire on September 30, 1999 and additional time is required for completion of the committee's work, HUD has renewed its charter.

The committee was formed to discuss and negotiate a proposed rule that would change the current method of determining the payment of operating subsidies to PHAs.

Notice PIH 99-38 (HA): Comprehensive Improvement Assistance Program (CIAP): Federal Fiscal Year (FFY) 1999 Application Submission, Processing and Fund Reservation
Issued August 20, 1999

The notice outlines the policies and procedures regarding application preparation and submission by PHAs for CIAP funds for FY 1999. For FY 1999, there is approximately $366 million available for CIAP PHAs. For the first time CIAP funds will be distributed by formula.

According to the notice, every eligible PHA (owning or operating less than 250 units) that responds to the notice will receive a distribution based on two equally-weighted factors: (1) A PHA's share of the total number of units eligible for CIAP; and (2) a PHA's share of the total number of bedrooms in units eligible for CIAP (with studio units counted as one-bedroom units).

Public Housing Agency Plan and Section 8 Certificate and Voucher Merger Announcement of Public Forum

The document announces the exact location of the public forum to be held in Syracuse, New York, on Public Housing Agency Plan interim rule and on the Section 8 certificate and voucher merger interim rule, and an additional public forum to be held on both rules in Washington, DC. Withdrawing and Reissuing FY 1999 Notice of Funding Availability for the Public Housing Drug Elimination Program; Notice

HUD is withdrawing the FY 1999 NOFA for the Public Housing Drug Elimination Program (PHDEP) published in the Federal Register of February 26, 1999 (64 FR 9745) and reissuing a NOFA that requests less information. Elsewhere in this issue of the Federal Register is HUD's proposed rule to implement the distribution of PHDEP funding under a non-competitive formula. The information requested by this notice will be used by HUD whether or not funds are distributed competitively, and will reduce the current reporting burden on applicants. This action is intended to prevent an interruption in the funding process while issues related to the proposed rule are resolved.

DATES: Requested information should be submitted by June 16, 1999.

Notice of Proposed Information Collection for Public Comment: Survey of Section 8 Certificate and Voucher Families

The document indicates that HUD plans to mail 276,000 surveys annually to representative certificate and voucher families asking questions about the physical condition of the tenant's unit. According to the notice, HUD intends to use the results of the survey as "an ongoing tool to assess customer ratings of housing assisted through the Section 8 Certificate and Voucher programs."

Because the notice is for proposed information collection, comments are limited to certain areas, such as whether collection of information is necessary; the accuracy of HUD's estimate of the burden imposed; to enhance the quality, utility, and clarity of the information to be collected; and to minimize the burden of the collection of information on those who are to respond.

The notice announces the monthly per unit fee amounts for use in determining the on-going administrative fee for HAs administering the Section 8 rental voucher, rental certificate and moderate rehabilitation programs (including Single Room Occupancy and Shelter Plus Care) during Federal Fiscal Year 1999.

The notice states that HUD will use the procedures in the notice to approve year-end financial statements for HA fiscal years ending on December 31, 1998; March 31, 1999; June 30, 1999; and September 30, 1999. "HAs also must use these procedures to project earned administrative fees in the annual HA budget. The procedures in this notice apply to administrative fees earned for that portion of the HA fiscal year that falls in Federal FY 1999 (i.e., from October 1, 1998, to September 30, 1999)."

Notice PIH 99-13 (HA): FY 1999 Subsidies for Operation of Low-Income Housing Projects

The notice advises HAs that the federal fiscal year 1999 operating subsidy appropriation is not sufficient to meet Performance Funding System (PFS) needs. Accordingly, HUD will make payments to all HAs based on 92.5 percent of the full eligibility.

HUD Offices were instructed not to process any year end adjustments or approve mid-year rental and utility adjustments. However, the notice states that "HAs are required to submit all mandatory year-end adjustments within the required time frames to enable the Department to analyze our ability to process them in the future if the FY 1999 funding shortfall situation changes as a result of Congress enacting a supplemental or operating subsidy requirements being lower than anticipated."

In addition, the notice indicates that for FY99 HUD will not be adopting three changes to the PFS to allow HAs to offset PFS funding shortfalls.

Privacy Act; Proposed Amendment to a System of Records

HUD is amending the system of records titled, "Tenant Eligibility Verification Files" -- HUD/PIH-1, previously published at 60 FR 53633; October 16, 1995. The amended notice cites two additional locations where records are maintained: HUD's Income Verification Centers in Chicago and Seattle. The amended notice also expands routine use to include evaluations of legal and regulatory compliance with rental assistance program requirements, program policies, and actions taken by entities that administer HUD's rental assistance programs, to resolve income discrepancies identified through computer matching.

Effective Date: This proposal shall become effective without further notice in 30 calendar days (March 11, 1999) unless comments are received during or before this period which would result in a contrary determination.

The notice explains the requirement that all HAs must submit 100 percent of MTCS data to HUD. The notice states that, to avoid sanctions, the minimum acceptable reporting rate is 85 percent. The notice also describes possible sanctions and the process for HAs to use when requesting a forbearance. The notice applies to the Section 8 and public housing programs.

Notice of Proposed Information Collection for Public Comment

This notice of proposed information collection alerts interested parties that Abt Associates Inc., a HUD contractor, will soon begin phase two of the Department's 10-year evaluation on the effectiveness of the HOPE VI program. The new study will be an "interim evaluation that will build on the original study by comparing conditions before and after revitalization and examining the impacts of the program to date at the original 15 study sites."
