ProPublica Releases Draft Proposed Rules on Mixed-Status Families, Work Requirements, and Time Limits

On September 29, ProPublica released draft copies of two HUD proposed rules along with an accompanying article analyzing both. The draft rules would, respectively:

  • Provide HAs with the flexibility to implement time limits and work requirements, and
  • Alter regulations regarding assistance provided to families where at least one member is considered an ineligible non-citizen (mixed-status families).

Draft versions of both the work requirement/time limit and mixed-status rules are available through ProPublica.

PHADA cautions members that the two rules are in draft form and may be changed prior to publication in the Federal Register. Both are also labeled as proposed rules and would be subject to a 60-day public comment period. HUD would then need to respond to comments before publishing final rules, which may be subject to subsequent litigation.
