On November 6, 2025, HUD released a pre-publication notice announcing an additional extension of the compliance dates for Energy Efficiency Standards in most HUD programs.
Originally published in April of 2024, the “Final Determination” adopted the 2021 edition of the International Energy Conservation Code (IECC) and the 2019 edition of ANSI/ASHRAE/IES Standard 90.1: Energy Standard for Buildings, Except Low-Rise Residential Buildings (ASHRAE 90.1) as the minimum energy standards for new construction of buildings under most federal housing construction funding. In March of 2025, HUD extended the compliance dates for all programs except for HOME and Housing Trust Fund because those dates had already passed. In July of 2025, HUD and USDA published a Notice for Comment announcing a planned review of the analysis that resulted in the 2024 Final Determination and requesting additional public comment.
The current announcement provides an additional delay of the compliance dates until May 28, 2026, for the following HUD programs: Federal Housing Administration-Insured (FHA-Insured) Multifamily, FHA-Insured Single Family, Public Housing Capital Fund, and Section 8 Project-Based Vouchers. The deadline for Competitive Grants (Choice Neighborhoods, Section 202, Section 811) is extended until the publication of the respective program NOFOs for FY2026. The department noted that a national building industry advocacy organization requested an additional extension. HUD also stated that for Section 8 Project-Based Vouchers, they intend to solicit additional public comment and publish further guidance on compliance for PBV.
HUD also reiterates that HOME and Housing Trust Fund-funded projects that include funding from programs with delayed compliance dates are not required to meet the revised standards and may utilize the extended compliance dates from the other programs for the project.
